Part 1 — Website & Communications Privacy Policy. Governs information we collect through 5c.co, our online forms, our email program, and our text messaging (SMS) program.
Part 2 — Notice of Privacy Practices (HIPAA). Governs protected health information created or received in the course of providing care to you.

Part 1 — Website & Communications Privacy Policy
5C ("5C," "we," "us," or "our") respects your privacy. This Part 1 explains what information we collect through our website, forms, email, and text messaging program, how we use it, how we protect it, and how to reach us.
Information We Collect

- Standard website analytics information, such as pages viewed and general geographic region
How We Collect Your Information
We collect information directly from you — when you complete a form on our website, when you call our office, or when you visit our office in person. We do not purchase, rent, or acquire your contact information from outside sources.
How We Use Your Information
We use your information to:
- Send you the SMS messages you have opted in to receive
- Respond to your questions, requests, and support inquiries
- Verify your identity when you access your account
- Send you email communications you have requested, which you may unsubscribe from at any time
- Understand how our website is used so we can improve it
- Operate and administer our business
Data Transfer
Your data will not be transferred to external organizations.
5C does not sell, rent, lease, trade, or otherwise transfer your personal information to any third party, affiliate, or external organization under any circumstances, including with your consent.
This applies without exception to text messaging information. Your mobile phone number, your SMS opt-in, and your SMS consent data will never be shared with any third party or affiliate for any purpose, including marketing or promotional purposes. No mobile information will be sold, rented, or shared with any third party or affiliate under any circumstances.
SMS Messaging Provacy
This section describes how 5C collects, uses, and protects information related to our SMS messaging program.
Data Collection. We collect your name, email address, mailing address, and mobile phone number when you consent to receive SMS updates. This information is collected through our website contact forms, by email, or through our patient intake forms.
Data Usage. We use this information to send appointment reminders, scheduling updates, and account-related notifications. You may also receive responses to inquiries you submit through our website or opt-in form.
Data Security. We protect your information using secure storage measures designed to prevent unauthorized access.
Data Retention. We retain your mobile number and SMS preferences for as long as you remain subscribed to our SMS program. You may request removal from our SMS list at any time. Retention of medical records is governed separately by applicable state and federal law.
Message and Data Rates. Message and data rates may apply. Your mobile carrier may charge fees for sending or receiving text messages, particularly if you do not have an unlimited texting or data plan.
Message Frequency. Messages are recurring. You may receive up to 6 messages per month.
Opt-Out. You may opt out at any time by replying STOP or UNSUBSCRIBE to any message, or by contacting us at (208) 215-7199 or info@5.codes. After you unsubscribe, you will receive one final message confirming your removal, and we will remove your number from our list within 24 hours.
Help. Reply HELP at any time for assistance. You will receive a message containing our phone number, email address, and website.
No Sharing of Mobile Information. We do not share your data with third parties for marketing purposes. 5C will not sell, rent, or share collected mobile numbers with third parties or affiliates.

Email Communications
If you subscribe to our email communications, you may unsubscribe at any time using the link in any email, or by contacting us using the information below. Unsubscribing from marketing email will not affect appointment-related or care-related communications.
Cookies and Website Analytics
Our website uses cookies and similar technologies to help the site function and to understand how visitors use it. You can control or disable cookies through your browser settings. Disabling cookies may affect how parts of the site work.
Protection of Information
We maintain administrative, technical, and physical safeguards designed to protect your information against unauthorized access, use, or disclosure. Access to your information within 5C is limited to personnel who need it to perform their job duties.
Children's Privacy
Our website and our text messaging program are not directed to children under 13, and we do not knowingly collect information from children under 13 through this website.

We may periodically update this Privacy Policy. If we make material changes that have a substantive and adverse impact on your privacy, we will post notice on this page before the change takes effect. We encourage you to review this page periodically.

Part 2 — Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

5C respects your privacy. We understand that your personal health information is very sensitive. The law protects the privacy of the health information we create and obtain in providing care and services to you. Your protected health information includes your symptoms, test results, diagnoses, and treatment, health information from other providers, and billing and payment information relating to these services.
We will not use or disclose your health information to others without your authorization, except as described in this Notice, or as required by law.
1. Your health information rights
The health and billing records we create and store are the property of 5C. The protected health information in them, however, generally belongs to you. You have a right to:
- Receive, read, and ask questions about this Notice.
- Ask us to restrict certain uses and disclosures. You must deliver this request to us in writing. We are not required to grant the request unless the request is to restrict disclosure of your protected health information to a health plan for payment or health care operations and the protected health information is about an item or service for which you paid in full directly.
- Request and receive from us a paper copy of the most current Notice of Privacy Practices.
- Request that you be allowed to see and get a copy of your protected health information. You may make this request in writing. We have a form available for this type of request.
- Have us review a denial of access to your health information, except in certain circumstances.
- Ask us to change health information that is inaccurate or incomplete. You may give us this request in writing. You may write a statement of disagreement if your request is denied. It will be stored in your medical record and included with any release of your records.
- Receive, upon request, a list of certain disclosures of your health information. The list will not include disclosures for treatment, payment, or health care operations. You may receive this information without charge once every 12 months. We will notify you of the cost involved if you request this information more than once in 12 months.
- Ask that your health information be given to you by another confidential means of communication or at another location. Please sign, date, and give us your request in writing.
- Cancel prior authorizations to use or disclose health information by giving us a written revocation. Your revocation does not affect information that has already been released, and it does not affect any action taken before we receive the revocation.

2. Our responsibilities
We are required to:
- Keep your protected health information private.
- Give you this Notice.
- Follow the terms of this Notice for as long as it is in effect.
- Notify you if we become aware of a breach of your unsecured protected health information, as required by federal law and by Idaho Code § 28-51-105.
We reserve the right to change our privacy practices and the terms of this Notice, and to make the new privacy practices and notice provisions effective for all of the protected health information we maintain. If we make material changes, we will update and make the revised Notice available to you. You may receive the most recent copy of this Notice by calling and asking for it, by visiting our office to pick one up, or by visiting our website.

We respect your right to file a complaint with us or with the Office for Civil Rights. If you complain, we will not retaliate against you.
4. How we may use and disclose your protected health information
Under the law, we may use or disclose your protected health information under certain circumstances without your permission. The following categories describe the different ways we may use and disclose your protected health information without your permission. Not every use or disclosure in a category is listed, but all of the ways we are permitted to use and disclose health information fall within one of the categories.
For treatment:
- We may contact you to remind you about appointments.
- We may use and disclose your health information to give you information about treatment alternatives or other health-related benefits and services.
- Information obtained by a nurse, physician, physician assistant, or other member of our health care team will be recorded in your medical record and used by members of our care team to help decide what care may be right for you.
- We may provide information to health care providers outside our practice who are providing you care or receiving a referral, so they can stay informed about your care.
For payment:
5C is a direct-pay practice and does not bill health insurance plans.
- We use your information to bill you directly and to process the payment methods you provide to us.
- If you choose to use a third-party financing or payment plan provider, we will disclose only the information necessary to process that arrangement, and only after you authorize it.
- We bill you, or the person you tell us is responsible for paying for your care.
For health care operations:
- We may use your medical records to assess quality and improve services.
- We may use and disclose medical records to review the qualifications and performance of our health care providers and to train our staff.
- We may use and disclose your information to conduct or arrange for services, including quality review, accounting, legal, risk management, and insurance services, and audit functions such as compliance programs.
For fundraising communications:
- We may use certain demographic information, dates of service, department of service, treating provider information, and outcome information to contact you to raise funds. If we contact you for fundraising, we will provide you with a way to opt out of receiving fundraising requests in the future, and we will honor that request.
Some of the other ways that we may use or disclose your protected health information without your authorization are as follows:
- Required by law: We must make any disclosure required by state, federal, or local law.
- Business associates: We contract with individuals and entities to perform functions for us or to provide services that may require them to create, maintain, use, or disclose your health information. We may disclose your health information to a business associate, but only after they agree in writing to safeguard your health information. Examples include our electronic health record vendor, billing services, and accountants.
- Notification of family and others: Unless you object, we may release health information about you to a friend or family member who is involved in your medical care. We may also give information to someone who helps pay for your care.
- Public health and safety purposes: As permitted or required by law, we may disclose protected health information to prevent or reduce a serious and immediate threat to the health or safety of a person or the public; to public health or legal authorities to protect public health and safety, to prevent or control disease, injury, or disability, and to report vital statistics such as births or deaths; and to report suspected abuse or neglect to public authorities. Idaho law requires us to report suspected child abuse, abandonment, or neglect under Idaho Code § 16-1605, and suspected abuse, neglect, or exploitation of a vulnerable adult under Idaho Code § 39-5303. We report communicable and reportable diseases and conditions to the Idaho Department of Health and Welfare and to the Panhandle Health District as required by Idaho law.
- Research: We may disclose protected health information to researchers if the research has been approved by an institutional review board or a privacy board and there are policies in place to protect the privacy of your health information. We may also share information with medical researchers preparing to conduct a research project.
- Coroners, medical examiners, and funeral directors: We may disclose protected health information to coroners, medical examiners, and funeral directors consistent with applicable law to allow them to carry out their duties.
- Organ procurement organizations: Consistent with applicable law, we may disclose protected health information to organ procurement organizations or to persons who obtain, store, or transplant organs.
- Food and Drug Administration: For problems with food, supplements, medications, devices, and other products, we may disclose protected health information to the FDA or to entities subject to the jurisdiction of the FDA.
- Workplace injury or illness: If you are treated for a work-related injury or illness covered by Idaho workers' compensation law, Idaho law and the rules of the Idaho Industrial Commission require us to submit written medical reports regarding your care to the payer and to you, and to disclose protected health information as necessary to administer the claim under Title 72, Idaho Code, and IDAPA 17.01.01.
- Correctional institutions: If you are in jail or prison, we may disclose your protected health information as necessary for your health and the health and safety of others.
- Law enforcement: We may disclose protected health information to law enforcement officials as required by law, such as reports of certain types of injuries or of victims of a crime, or when we receive a warrant, subpoena, court order, or other legal process.
- Government health and safety oversight activities: We may disclose protected health information to an oversight agency conducting an investigation, audit, licensure action, or similar activity. For example, we may share health information with the Idaho Department of Health and Welfare or the Idaho State Board of Medicine.
- Disaster relief: We may share protected health information with disaster relief agencies to assist in notifying your family or others of your condition.
- Military, veterans, and Department of State: We may disclose protected health information to military authorities of U.S. and foreign military personnel, and to the Department of State as required for certain determinations.
- Lawsuits and disputes: We may disclose protected health information in the course of judicial or administrative proceedings at your request, or as directed by a subpoena or court order.
- National security: We may release protected health information to federal officials for national security purposes authorized by law.
- De-identified information: We may use your health information after removing all information that could be used to identify you.
5. Uses and disclosures that require your written authorization
Certain uses and disclosures of your health information require your written authorization:
- Psychotherapy notes: If we record or maintain psychotherapy notes, we must obtain your authorization for most uses and disclosures of those notes.
- Marketing communications: We must obtain your written authorization to use or disclose your health information for marketing purposes, other than face-to-face communications with you, promotional gifts of nominal value, and communications with you about a currently prescribed treatment or product, such as refill reminders.
- Photographs, video, and audio: We must obtain your separate written authorization before using any photograph, video, audio recording, or likeness of you for marketing, advertising, social media, website content, podcast content, or educational or promotional purposes. Clinical photography taken for your medical record does not require separate authorization; any use of that photography outside your medical record does.
- Reviews, testimonials, and social media: We will not confirm that you are a patient of 5C, or disclose any information about your care, in response to an online review, comment, or social media post without your written authorization.
- Sale of health information: Any disclosure that constitutes a sale of your health information requires your authorization.
Other uses and disclosures of your health information that are not described in this Notice will be made only with your written authorization. You have the right to cancel a prior authorization by giving us a written revocation. Your revocation does not affect information that has already been released, and it does not affect any action taken before we receive the revocation.
6. Minors
Where Idaho law permits a minor to consent to their own care, the minor generally controls the protected health information related to that care, and we will handle requests for that information as Idaho law requires.
